ABOUT THE PROJECT...
Although Romania is officially a unitary country from a legal standpoint, without administrative divisions and without parallel legal or normative systems to the state system, we cannot deny the special situation of the Roma minority. This unique research project (other research projects have addressed the issue rather timidly), led by the Babes-Bolyai University, seeks to increase awareness and understanding of customary justice in Roma communities.
The first step was the analytical description of forms and processes of organization and customary legal practice of Roma in Romania. To achieve this overall objective, the team sought to achieve particular objectives:
1- Mapping Roma communities in Romania from the perspective of the historical existence and effectiveness of contemporary forms of customary legal organization;
2- Identifying institutions and processes within the Roma customary law present in Romania;
3- Analyzing the forms of participation of Roma and non-Roma actors in Romania in various aspects of the implementation process of the Roma customary law.
To do this, researchers have completed several field missions in the Roma communities to observe stabors, customary courts known for their great diversity.
